EXTRA SERVICES

All Strata offers a range of Extra services to its clients. These services are subject to the direction of the Council of Owners, and attract an additional charge at an hourly rate or pro rata for part of an hour.

ü  Attendance at Extraordinary or Council meeting both during business hours and after hours

ü  Make application to Government authorities

ü  Instruct and liaise with lawyers in accordance with Strata Company resolutions

ü  Assist Strata Company in tribunal (SAT) or court hearings

ü  Arrange lawyer drafting of by-laws changes to by-laws, consolidation of by-laws and by-law reviews.

ü  Arrange lodgement of pre prepared by-laws

ü  Arrange Security and Concierge Services

ü  Arrange Building Facility Services

ü  Arrange Building condition Surveys

ü  Attendance on site with Council

ü  Managing of Dividing Fence disputes

ü  Any work related to new developments (defects)

According to the Strata Titles Act :

105.    Roll to be kept by strata company

(1)       A strata company must prepare and maintain a roll containing the particulars required by subsection (4).
(2)       The roll may be kept in any medium.
(3)       A strata company may make or amend entries in the roll on the basis of —

(a)       the information in documents registered under this Act; or
(b)       subject to subsection (5), information provided by, or on behalf of, an owner or a mortgagee of a lot.

(4)       The particulars to be entered in the roll are —

(a)       the name of the strata company; and
(b)       the name and address for service of each member of the council, or officer, of the strata company; and
(c)       the name and address for service of the owner of each lot; and
(d)       the name and address for service of each strata manager of the strata company; and
(e)       the name and address for service of any lessee or tenant of a lot notified to the strata company; and
(f)        the name and address for service of any mortgagee of a lot notified to the strata company.

(5)       A strata company must not amend the roll —

(a)       to reflect the discharge of a mortgage except on the basis of
(i)        information provided by, or on behalf of, the mortgagee; or
(ii)       the production of a duplicate or a certified copy of a certificate of title showing the mortgage as having been discharged; or
(b)      to show a change of address of a mortgagee except on the basis of information provided by, or on behalf of, the mortgagee.

In accordance with Section 107 of the Strata Titles Amendment Act 2018 a person with a proper interest in information about a Strata Titles Scheme, or a person authorised in writing by such a person, may apply in writing to the Strata Company for the scheme for;

(a)           information under section 108 or
(b)          inspection of material under section 109 or
(c)           a certificate under section 110

Fees for applications under s. 107

(1)       For the purposes of section 107(4), the following amounts are fixed as the maximum fee for an application under section 107 —

a)         in the case of an application for information under section 108 — $10;
b)        in the case of an application for inspection of material under section 109 —
(i)        if the application is by a person who has a proper interest in information about a strata titles scheme — $1; or
(ii)      if the application is by a person authorised in writing by the person referred to in subparagraph (i) — $100;

(c)       in the case of an application for a certificate under section 110 specifying the matters referred to in section 110(1) — $140;
(d)       in the case of an application for a certificate under section 110 specifying the matters referred to in section 110(2) — $140.
(2)       An application under section 107 is not duly made to a strata company until the fee (if any) charged by the strata company for the application has been paid.
(3)       A maximum fee under this regulation is increased by 10% if the strata company is required to remit GST for the provision of the service for which the fee is payable.

Inspection of material

(1)       For the purposes of section 109(4)(a), a strata company may, by notice in writing to an applicant, specify requirements for the taking of extracts from, or the making of copies of, material that a person inspects under section 109.
(2)       A person inspecting material under section 109 may take extracts from, or make copies of, the material but only in accordance with those requirements.
(3)       Sub regulation (1) does not authorise a strata company to prevent or impose restrictions on the person photographing any of the material during the inspection using the person’s own camera.
(4)       A strata company cannot charge the person a fee for any such photographing.

 Maximum charge for copies of material

(1)       For the purposes of section 109(5), the following amounts are fixed as the maximum fee that may be charged by a strata company for providing a copy of material under section 109 —

(a)       for the supply of a copy of the material on a portable data storage device provided by the strata company —  $50 plus the actual cost of the device being a further $10;
(b)       for the supply of a photocopy of the material — $50 for the first 5 pages plus $1 for each extra page of the photocopy;
(c)       for the supply of an electronic copy of the material by email or other electronic transmission — $50.

(2)     A strata company may refuse to provide a copy of material until the fee (if any) charged by the strata company under section 109(5) for providing the copy is paid.
(3)     A maximum fee under this regulation is increased by 10% if the strata company is required to remit GST for the provision of the service for which the fee is payable.
